HC orders SIT not to arrest Santosh till further orders

Asking the Special Investigation Team (SIT) to explain how serving notices under Section 41 (A) of CrPC to BJP General Secretary (organisation) BL Santhosh and Telangana BJP President Bandi Sanjay Kumar’s associate B. Srinivas leaked to the press, the Telangana High Court rejected the plea of the BJP to cancel the notices issued by the SIT and to stay the notices issued to BL Santhosh and advocate B. Srinivas.

However, the HC directed the SIT not to arrest Santhosh till orders are issued. The High Court directed the SIT to keep the probe secret and to conduct the probe transparently.
Making it clear that there is no chance for arrests under Section 41 (A) of CrPC, the High Court directed the SIT to inform the Delhi Police to issue a notice to BL Santhosh.

The HC directed the SIT to hand over the Section 41(A) notices to the Delhi Police and the Delhi Police should serve the notice to BL Santhosh.The court posted the case to November 22 and directed BL Santhosh and Srinivas to cooperate with the SIT’s probe.
The High Court held the hearing on the SIT’s lunch motion petition along with the BJP’s petition.

The SIT mentioned in its petition that the Delhi Police is not cooperating in serving notices. It also said in its petition that the Delhi Police are not cooperating with the probe.
The SIT urged the High Court that it must direct the Delhi Police Commissioner not to block the investigation.

It may be recalled that Telangana BJP General Secretary Gujjula Premender Reddy had filed a lunch motion petition requesting the HC to cancel the notices issued to BL Santhosh and B. Srinivas as they have no role in it and as the SIT had served the notices as part of a conspiracy against them.

Meanwhile, the Hyderabad City Police Commissioner CV Anand-headed SIT issued notices to BL Santhosh and B. Srinivas and some others asking them to appear before the SIT at the Hyderabad Command and Control Centre on November 21 at 10.30 am.
