He said that someone challenged in the High Court whether the HYDRAA is legal or not. The HYDRAA is a legal agency, as this is constituted by the executive resolution. A lot of bodies were floated through executive resolutions like the Planning Commission. That was formed through an executive resolution in March of 1950.
He said that the Cabinet Secretariat, Law Commission, like this many bodies were constituted through a government order or executive order. In the State government also many agencies were formed through Government orders like the ACB, Vigilance Enforcement and other bodies.
He said that shortly there is an ordinance which is likely to come up probably next month or so. Powers under various acts will be delegated onto HYDRAA. Once it is approved in the Cabinet, then an ordinance will be issue. After the ordinance, in the next Assembly session, ordinance will be tabled, he said.
“We take care of assets of the government like lakes, nalas, government lands, parks and other government lands, including traffic related encroachment. As per the GO , we do not issue any notices. We assist the local authorities like municipalities, revenue and other authorities.”
