During the bail petitions of former DSP Praneeth Rao and former DCP (Task Force) Radhakishan Rao, the counsel for the accused on Wednesday cited the 2G Spectrum case and the Chidambaram case (the INX Media case) to grant the bail.
During the arguments of the two accused in the phone-tapping case, the counsel said that the three-judge Bench in Chidambaram case reaffirmed the bail jurisprudence. The Supreme Court’s observation on bail emphasised that bail is the rule and jail is the exception.
Meanwhile, the counsel asked the court whether the police collected the record of purchase of hard disks. If they are obtained from the Special Intelligence Bureau (SIB), those are matching with the police’s found material objects’ serial and model numbers.
The counsel said that the police have not submitted the document on how many numbers have been intercepted by the accused. The counsel for the accused said that there is no scope for tampering with any evidence and obstructing the investigation. It has been five months since the accused have been arrested. However, the chargesheet was also filed before the court.
The counsel for the accused asked that on Tuesday, the Public Prosecutor told the court that the case is not about the cash seizure, then why the police have arrested Radhakishan Rao in this case.
After hearing the arguments over the bail petitions of the two accused, the court called for the orders on July 9.
