Centre gives free hand to AP govt over action on ABV

The Central government on Tuesday gave a freehand to the Y S Jagan Mohan Reddy government to take departmental action against senior IPS officer and former intelligence chief of Andhra Pradesh A B Venkateswara Rao, in connection with the alleged violation of rules in procuring security systems from Israel during his regime. Union Minister of Home Affairs, under secretary Sanjeev Kumar sent the official communication to Chief Secretary, AP Government allowing disciplinary proceedings against Venkateswara Rao.

In the letter to Chief Secretary K S Jawahar Reddy, the Union Ministry of Home Affairs permitted him to take disciplinary action against Venkateswara Rao. The letter stated that with the approval of the Competent Authority, records of the case relating to disciplinary proceedings initiated by the State Government against A.B. Venkateswara Rao, IPS (AP 1989) vide charge-sheet dated 18.12.2020, were submitted to UPSC on 21.02.2022 for the advice of the Commission on the quantum of penalty that may be imposed on him.

UPSC A wide letter No.3/427/21-S.I dated 21.10.2022 have advised for the imposition of the penalty on the ‘charged officer’.

The Union Ministry of Home Affairs permitted the Jagan government to the reduction in the time scale of pay by two stages till 31st May 2024 (31.05.2024) imposed on the MoS, Venkateswara Rao with further directions that he will not earn increments of pay during such period and, on expiry of said period, the reduction will have the effect of postponing future increments of his pay.

In this connection, it is stated that in terms of Rule 7(2) of the AIS (D&A) Rules, 1969, the penalty of dismissal, removal, or compulsory retirement shall not be imposed on a member of the Service except by an order of the Central Government. However, in the present case, UPSC has not advised the imposition of the penalty of dismissal, removal, or compulsory retirement on the ‘charged officer’.
