The Bhupalpally Principal Sessions Court issued notices to former Chief Minister K. Chandrasekhar Rao and eight others including former Minister T. Harish Rao regarding the damage suffered by the Medigadda Barrage.
Accepting the revision petition submitted by one Nagavelli Rajalingamurthy, the court stated that it will hear the case on September 5. The court directed the nine persons, who are being served notices, to attend hearing on September 5. Earlier, Rajalingamurthy had approached the Bhupalpally First Class Principal Judicial Magistrate Court. However, the court dismissed his petition. Then Rajalingamurthy approached the High Court alleging that the First Class Principal Judicial Magistrate Court dismissed his petition without citing any reason.
Then the High Court suggested that Rajalingamurthy should submit a revision petition in the Bhupalpally district court. Rajalingamurthy filed a revision petition in the Bhupalpally Principal Sessions Court then.
Rajalingamurthy said that he lodged a complaint with the local police station on October 25 when the Medigadda Barrage was damaged. Later, Rajalingamurthy also filed a complaint with the SP and the DGP. However the police did not register an FIR and did not take any action. Then he approached the court, Rajalingamurthy mentioned in his revision petition.
Rajalingamurthy said that some people had said that the Medigadda Barrage was damaged due to terrorist action. He said the police had also filed an FIR (No: 174/2023) as per IPC Section 427. However, the police closed it on the very next day itself.
Rajalingamurthy said in his revision petition that Chief Minister KCR and irrigation Minister T. Harish Rao were responsible for ensuring quality and that they were negligent in maintaining the Medigadda Barrage and also in allowing a design defect.
In fact, Rajalingamurthy named KCR, Harish Rao, the then Irrigation secretary Rajat Kumar, CMO secretary Smitha Sabarwal, Engineer-in-Chief Hariram, Chief Engineer Sridhar and others as respondents and the court issued notices to them.
