Sleuths of the Special Investigation Team (SIT) submitted pieces of evidence related to the petitions in the case relating to alleged poaching of 4 TRS MLAs to Justice B. Vijaysen Reddy of the Telangana High Court. The evidence submitted shows that A1 Ramachandra Bharati and A4 B L Santhosh know each other from a long time based on WhatsApp message conversation between them (see screenshot of saved chat between them of August 2021) Another piece of evidence is related to the meeting of B L Santhosh and Ramchandra Bharati on 11th April at Haridwar and message of A1 Ramachandra Bharati to A4 B L Santhosh on 26-04-2022 about giving update on Telangana operation. Interestingly, Prof Kodandaram’s name also figured.

Evidence related to Simhayaji conducting a meeting at Sky High Hotel with political leaders proposing to shift from their current party to BJP viz. M Kodandaram of Telangana Jana Samithi, Damodar Raja Narasimha of Congress Party, etc. Details of conspiracy meeting on 21-08-2022 between A1 Ramachandra Bharati, A3 Simhayaji, Advocate P Pratap and K C Pandey, president of the World Brahmin Federation at K C Pandey’s house in Kalkaji, Delhi were shared.

The most important conspiracy meeting on 15-10-2022 at the House of B L Santhosh (government quarters) at 10am between A4 BL Santhosh, A5 Tushar Vellappaly, A1 Ramachandra Bharati, A2 Nandu Kumar Kore and Munjagalla Vijay Kumar. This is based on phone location of all of them, confession of Munjagalla Vijay Kumar, video of the house of B L Santhosh in the mobile phone of Munjagalla Vijay Kumar, photograph of A5 Tushar Vellappaly & A2 Nandu and A5 Tushar Vellappaly & Munjagalla Vijay Kumar at the house of B L Santhosh, travel documents, stay details at Delhi, confession of advocate P Pratap.

Conspiracy meeting between A1 Ramachandra Bharati, A2 Nandu Kumar, A3 Simhayaji and advocate Busarapu Srinivas at the World Brahmin Federation office, Delhi on 04-09-2022. 7. Conspiracy meeting of A2 Nandu Kumar, A3 Simhayaji and A7 advocate Busarapu Srinivas went to RSS headquarters at Nagpur, attended annual conference of Bharatiya Raksha Manch and met many leaders.

One of the main conspiracy meetings took place at Nandu’s House on 26-09- 2022 between A1 Ramachandra Bharati, A2 Nandu Kumar Kore, A3 Simhayaji, A7 Advocate Busarapu Srinivas, advocate P Pratap, Munjagalla Vijay Kumar and de facto complainant to make proposal for change of party and to bring other MLAs.

WhatsApp conversation, calls and regular calls/messages related to the poaching of MLAs among A1 Ramachandra Bharati, A2 Nandu, A3 Simhayaji, A6 Dr Jaggu Swamy, A7 advocate Busarapu Srinivas, advocate P Pratap and Munjagalla Vijay Kumar between 26-09-2022 to 14-10-2022 were shared.

WhatsApp conversation, calls and regular calls/messages related to the poaching of MLAs among A1 Ramachandra Bharati, A2 Nandu, A3 Simhayaji, A6 Dr Jaggu Swamy, A7 Advocate Busarapu Srinivas, advocate P Pratap and Munjagalla Vijay Kumar between 15-09-2022 to 26-10-2022. (WhatsApp chat among all the above) The occurrence of offence on 26-10-2022 where meeting was conducted by A1 Ramachandra Bharati, A2 Nandu Kumar Kore, A3 Simhayaji with de facto complainant and 03 other MLAS at the farmhouse of de facto complainant.

Ramchandra Bharati sent a message to B L Santhosh from the farmhouse of MLA Rohit Reddy on 26.09.2022 stating specifically that “as he discussed previously about Telangana”. Regular calls and WhatsApp calls depicting regular contacts between A1 Ramachandra Bharati, A2 Nandu Kumar Kore, A3 Simhayaji, A4 B L Santhosh, A5 Tushar Vellappaly, A6 Dr Jaggu Swamy and A7 advocate Busarapu Srinivas were submitted as evidence. Voice/Audio clippings of A1 Ramchandra Bharati, A2 Nandu Kumar Kore and A3 Simhayaji on their respective phones with content related to poaching of MLAs were shared.

Dushyanth Dave, appearing for Telangana govt, said that he did not believe in furnishing crucial information in sealed covers and hence was giving the details of the evidence in the open court, while passing on copies of the files to other parties.

Mahesh Jethmalani, appearing for the accused, argued the matter and informed the Court that all the three petitioners/ accused are in jail and they don’t belong to any political party.

Jethmalani said: “Leaking out excerpts of evidence to the media is certainly not in accordance with law. Petitioners just want a fair investigation by the independent agency CBI or SIT. Give fairness in the investigation, Moreover, the independent agency chosen by the High Court is amiable, Mahesh Jethmalani argued before the Court. Police undermine the presumption of innocence by publicly giving the evidences”. Mahesh Jethmalani concluded his argument by making submission to transfer the case to CBI or SIT for fair investigation.Meanwhile SIT Chairman C V Anand released a note saying that they did not leak the information to the media.The next hearing is posted to December 6.
